Rental Agreement

TERMS AND CONDITIONS (For CELEBRATION PACKAGE):

 

  1. RENTAL PROPERTY:

The LESSOR leases to the LESSEE, and the LESSEE leases from the LESSOR, subject to the terms and conditions of this Agreement, the following property:

 

1.1. PROPERTY ADDRESS:

6502 Michael Street, Remedios Ville Subdivision, Capaya 1, Angeles City.

 

1.2. DESCRIPTION OF PROPERTY:

A private villa and all its fixtures, furniture, appliances, and amenities (hereinafter, “the Premises“).

 

1.3. AREAS OF THE PREMISES:

The Premises is separated into two areas:

 

1.3.1. LODGING AREA:

The indoor area (hereinafter, “VILLA“) is a 2-storey, 3-bedroom house, including the living room, kitchen, dining area, bedrooms, bathrooms, and all its fixtures, furniture, appliances, and amenities.

 

1.3.2. OUTDOOR EVENT SPACE:

The outdoor area (hereinafter, “RESORT“) includes the pool, pavilion, outdoor garden area, outdoor showers, outdoor bathrooms, outdoor event space, and all fixtures, furniture, appliances, and amenities located outside the VILLA.

 

1.4. PROPERTY USE:

The Premises shall be used solely for short-term residential use and private events.

 

1.5. OTHER AMENITIES:

The LESSOR provides the following items and appliances for the LESSEE’s use during their stay:

  • BEDROOMS: Air conditioner, bedding, pillows, flat sheets.
  • KITCHEN: Refrigerator; hot and cold water dispenser; electric kettle; rice cooker; 15 sets of plates, glasses, spoons, forks, teaspoons, coffee mugs; knives.
  • RESORT: Billiard table with 16 balls & sticks, badminton set, 3 calesa tables with umbrellas, 5 folding tables, 2 long tables, 50 plastic chairs, grilling station, basketball hoop.
  • OTHER INDOOR ITEMS: Flat-screen TV, foosball table.

 

  1. TERM OF LEASE:
  • The lease shall begin on [check-in date], at 2:00 PM and end on [check-out date], at 12:00 PM.
  • The Premises must be vacated by Check-Out Time.
  • The LESSOR shall inspect the property 30 minutes before check-out for any damage or loss.

 

  1. RENTING PARTY:
  • The “Renting Party” (referred to as “Guests“) consists of the LESSEE and their guests or any other persons permitted by the LESSEE to access the Premises.
  • The LESSEE shall be responsible for the conduct of all Guests during their stay.

 

  1. RENTAL FEES, DEPOSITS, AND OTHER CHARGES:

 

4.1. RENT:

The Rent for the use of the Premises is [rent amount], payable on or before [check-in date] at 2:00 PM.

 

4.2. RESERVATION DEPOSIT:

A non-refundable Five Thousand Pesos (Php 5,000.00) deposit is required to secure the booking. This amount will be credited toward the rent but will be forfeited if the LESSEE cancels the booking.

 

4.3. SECURITY DEPOSIT:

A refundable Five Thousand Pesos (Php 5,000.00) security deposit is due on or before [check-in date] at 2:00 PM. This deposit covers damages, missing items, excessive cleaning costs and other charges. The deposit will be refunded within one (1) day after check-out, minus any applicable deductions for damage or missing items. If the costs exceed the deposit, the LESSEE will be billed for the excess.

 

4.4. OVERSTAY/LATE CHECK-OUT FEE:

A Php 1,000.00 per hour fee for each villa will be charged for staying beyond the check-out time.

 

4.5. EXTRA GUEST FEE:

An additional Php 300.00 per person will be charged for each guest beyond the agreed number.

 

4.6. CLEANING FEE:

A Php 1,000.00 cleaning fee will apply if the Premises require excessive cleaning after the stay.

 

4.7. SMOKING FEE:

A Php 1,000.00 fee will be charged if any Guest violates the no-smoking policy inside the Premises.

 

  1. PAYMENTS:
  • All payments must be made via cash, GCash, or Maya. Payment instructions will be provided upon booking confirmation.

 

  1. MAXIMUM OCCUPANCY AND HOURS OF USE:

 

6.1. LODGING AREA:

The maximum number of overnight guests allowed is fifteen (15). All names must be provided at check-in for registration. Only registered guests are allowed on the Premises after 9:00 PM.

 

6.2. OUTDOOR EVENT SPACE:

A maximum of fifty (50) people are allowed in the RESORT. Guests who are not registered for overnight stay are not allowed on the Premises between 9:00 PM and 8:00 AM the next day.

 

6.3. EXTRA GUESTS:

Any extra guests beyond the agreed number must have prior approval from the LESSOR and may incur an additional fee of Php 300.00 per person.

 

  1. HOUSE RULES:
  • The LESSEE acknowledges receipt of the attached House Rules and agrees to abide by them.
  • The LESSEE is responsible for ensuring that all Guests comply with these rules.

 

  1. 100% SMOKE-FREE INDOORS POLICY:

 

8.1. SMOKING:

For safety and comfort, smoking is strictly prohibited indoors. This includes cigarettes, tobacco, marijuana, e-cigarettes, vaping, cigars, and incense.

 

8.2. COOKING:

Cooking indoors is not allowed due to odor concerns that are difficult to remove.

 

  1. NON-DISTURBANCE CLAUSE:
  • Guests must not disturb or inconvenience neighbors. Any unlawful activity or behavior, including drug use, verbal or physical abuse, or illegal conduct, will result in immediate eviction without refund.

 

  1. NOISE RESTRICTIONS:
  • Excessive noise is prohibited, especially during nighttime hours.
  • The LESSEE agrees to respect community guidelines and ensure that noise levels are kept to a minimum after 10:00 PM, including loud music, videoke, or karaoke.

 

  1. NO PETS POLICY:
  • A strict No Pets Policy is enforced. No pets of any kind are allowed on the Premises. Any violation will result in immediate termination of this Agreement without refund.

 

 

  1. SWIMMING POOL USE:

 

12.1. USE HOURS:

The pool is available for use throughout the stay, though the pool pump and jacuzzi (bubbles) will be turned off at 10:00 PM for maintenance. The LESSEE will be notified if the pool is under treatment.

 

12.2. SUPERVISION:

Children must be accompanied by an adult at all times while in or near the pool.

 

12.3. SAFETY:

The LESSEE agrees to follow all safety guidelines posted near the pool and avoid dangerous behavior.

 

12.4. EATING AND DRINKING:

Eating or drinking, especially alcohol, near or in the pool is prohibited.

 

12.5. SWIMMING ATTIRE:

Appropriate swimwear must be worn at all times while using the pool.

 

12.6. POOL USE DISCLAIMER:

The LESSEE acknowledges the risks associated with pool use and agrees to hold the LESSOR harmless from any injury or damage that may occur. The LESSOR does not provide a lifeguard on duty, and the LESSEE is fully responsible for the safety of all pool users, including children. The LESSOR is not liable for any accidents, injuries, or damages related to pool use.

 

  1. DAMAGES AND LIABILITY:

 

13.1. PROPERTY DAMAGE AND/OR THEFT:

The LESSEE is responsible for any damage or theft of the Premises or its contents, whether caused by accident, negligence, or intentional acts. The LESSEE agrees to cover the costs of repair or replacement.

 

13.2. LIABILITY WAIVER:

The LESSOR is not liable for any injury, loss, or damage to the LESSEE or their guests, whether inside or outside the Premises. The LESSEE agrees to indemnify and hold the LESSOR harmless from all claims related to their use of the Premises.

 

13.3. ASSUMPTION OF RISK:

The LESSEE assumes all risks associated with recreational activities, including swimming.

 

13.4. PERSONAL PROPERTY:

The LESSEE is advised to secure personal property insurance, as the LESSOR is not liable for any loss or damage to personal belongings.

 

  1. MAINTENANCE AND ALTERATIONS:

 

14.1. PROPERTY CONDITION:

The LESSEE agrees to maintain the Premises in a clean and safe condition and to return it in the same condition, except for ordinary wear and tear.

 

14.2. ALTERATIONS:

The LESSEE shall not make any structural changes or alterations to the Premises, including installing nails, hooks, screws, or new locks.

 

14.3. REPAIRS:

The LESSEE shall promptly report any maintenance issues. The LESSOR will attempt to address these but cannot guarantee that all appliances or equipment will be in perfect working order. No refunds will be issued for equipment malfunctions.

 

14.4. PROPERTY ACCESS:

The LESSOR or their agent may enter the Premises for inspections or maintenance with reasonable notice. In emergencies, the LESSOR may enter without notice.

 

  1. EATING AND DRINKING IN THE BEDROOMS:
  • Food and drinks are not allowed in the bedrooms to maintain cleanliness and avoid damage to furniture or bedding.
  1. SUB-LEASE:
  • The LESSEE may not sublet or assign the lease without the prior written consent of the LESSOR.

 

  1. PUBLIC UTILITIES:
  • The LESSOR is not responsible for any loss of use or interruption of utility services beyond their control (e.g., water, electricity, internet).

 

  1. INSURANCE AND INSPECTIONS:

 

18.1. INSURANCE:

The LESSEE is encouraged to obtain personal travel insurance, including coverage for damage to the Premises and medical emergencies.

 

18.2. INSPECTIONS:

The LESSOR reserves the right to inspect the Premises during the rental period with prior notice to ensure compliance with the Agreement.

 

  1. CANCELLATION POLICY:

 

19.1. CANCELLATION BY LESSEE:

The LESSEE may cancel the booking 60 days before the Check-in Date for a full refund, minus any bank or online payment processing fees, if applicable.

 

19.2. CANCELLATION BY LESSOR:

If the LESSOR cancels the booking for any reason, the LESSEE will be refunded the full amount paid, including the reservation deposit, within one (1) day.

 

  1. CCTV MONITORING:
  • CCTV cameras are installed at the Premises for monitoring/security purposes, except in bedrooms, restrooms, and other private areas.

 

  1. FORCE MAJEURE:
  • If the Premises are rendered uninhabitable due to unforeseen events (e.g., fire, flood, storm), the LESSOR may cancel the Agreement. The LESSEE will receive a full refund of all payments made.

 

  1. JUDICIAL RELIEF:
  • Should the LESSOR need to seek legal relief against the LESSEE, the LESSEE agrees to pay all reasonable legal costs, including attorney’s fees.

 

  1. SEVERABILITY:
  • If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

 

  1. MISCELLANEOUS:

 

24.1. ENTIRE AGREEMENT:

This Agreement supersedes any prior agreements or representations, whether written or oral.

 

24.2. AMENDMENTS:

Any amendments must be in writing and signed by both parties.
