Rental Agreement: Celebration Package

  1. RENTAL PROPERTY:

The HOST grants the GUEST a temporary license to occupy, subject to the terms and conditions of this Agreement, the following property:

 

1.1. PROPERTY DESCRIPTION:

A private two-storey villa, including all its associated fixtures, furniture, appliances, and amenities (hereinafter, “the Premises”) located at 6502 Michael Street, Remedios Ville Subdivision, Capaya 1, Angeles City.

 

1.2. AREAS OF THE PREMISES:

The Premises are divided into two areas:

 

1.2.1. LODGING AREA (VILLA):

The indoor area (hereinafter, “VILLA”) includes the living room, kitchen, dining area, bedrooms, bathrooms, and all its fixtures, furniture, appliances, and amenities.

 

1.2.2. OUTDOOR EVENT SPACE (RESORT):

The outdoor area (hereinafter, “RESORT”) includes the pool, pavilion, outdoor garden area, outdoor showers, outdoor bathrooms, outdoor event space, and all fixtures, furniture, appliances, and amenities located outside the VILLA.

 

1.3. PROPERTY USE:

The Premises shall be used solely for short-term residential use and private events. The Premises shall not be used for commercial purposes, including but not limited to paid events, ticketed gatherings, business operations, or professional shoots without prior written consent of the HOST; illegal activities; or any activity that may damage the property or disturb the surrounding community.

 

1.4. OTHER AMENITIES:

The HOST provides the following items and appliances for the GUEST’s use during their stay:

  • BEDROOMS: Air conditioner, bedding, pillows, flat sheets.
  • KITCHEN: Refrigerator; hot and cold water dispenser; electric kettle; rice cooker; 15 sets of plates, glasses, spoons, forks, teaspoons, coffee mugs; knives.
  • RESORT: Billiard table with accessories, Pinoy pool table, badminton set, 3 calesa tables with umbrellas, 5 folding tables, 2 long tables, 50 plastic chairs, grilling station, basketball hoop.
  • OTHER INDOOR ITEMS: Flat-screen TV, foosball table, Cello 2 karaoke.

 

  1. RENTAL TERM/PERIOD OF STAY:
  • The rental period shall begin on [mm/dd/yyyy], at 2:00 PM (check-in time) and end on [mm/dd/yyyy], at 12:00 PM (check-out time).
  • The Premises must be vacated by Check-Out Time.
  • The HOST may conduct a pre-check-out inspection at a mutually convenient time within 30 minutes prior to check-out, with prior notice to the GUEST.

 

  1. RENTING PARTY:
  • The “Renting Party” (referred to as “Guests“) consists of the GUEST and their guests or any other persons permitted by the GUEST with the approval of the HOST to access the Premises.
  • The GUEST shall be responsible for the conduct of all Guests during their stay.

 

3.1 GUEST IDENTIFICATION:

The GUEST (lead guest) must present a valid government-issued ID at check-in and provide a list of all guests prior to arrival. The HOST may require valid identification from any guest when reasonably necessary.

 

  1. RENTAL FEES, DEPOSITS, AND OTHER CHARGES:

 

4.1. RENT:

Fifteen Thousand Pesos (Php 15,000.00), payable on or before check-in time.

 

4.2. RESERVATION DEPOSIT:

A Five Thousand Pesos (Php 5,000.00) reservation deposit is required to secure the booking. This deposit will be credited toward the rent but is non-refundable in case of cancellation, except in events covered under Force Majeure or as otherwise provided under Section 23.

 

4.3. SECURITY DEPOSIT:

A Five Thousand Pesos (Php 5,000.00) refundable security deposit is due on or before check-in time. This deposit covers damages, missing items, excessive cleaning costs, and other documented charges directly related to the GUEST’s use of the Premises. The deposit will be refunded within one (1) to three (3) days after check-out and completion of inspection, minus any deductions for damages or missing items. If damages require further assessment, the refund period may be reasonably extended, provided that the GUEST is notified. If the costs exceed the deposit, the GUEST will be billed for the excess.

 

4.4. HOLDOVER/OVERSTAY/LATE CHECK-OUT FEE:

Failure to vacate the Premises at check-out time shall result in an additional charge of Php 1,000.00 per hour and may result in removal of the GUEST.

 

4.5. EXTRA GUEST FEE:

Three Hundred Pesos (Php 300.00) per person beyond the maximum occupancy stated in Section 6.

 

4.6. CLEANING FEE:

A Php 1,000.00 cleaning fee will apply if the Premises require excessive cleaning after the stay.

 

4.7. SMOKING FEE:

A Php 1,000.00 fee will be charged for violations of the indoor no-smoking policy under Section 8.

 

  1. PAYMENTS:

Payments must be made via cash, GCash, or Maya. Payment instructions will be provided upon booking confirmation. Full payment must be completed prior to or at check-in.

 

  1. MAXIMUM OCCUPANCY AND HOURS OF USE:

The HOST may refuse entry if the GUEST violates this Agreement, including exceeding the maximum number of guests. In such cases, all payments made may be forfeited, subject to applicable provisions of this Agreement.

 

6.1. LODGING AREA:

The maximum number of overnight guests allowed is fifteen (15). All names must be provided at check-in for registration. Only registered guests are allowed on the Premises after 9:00 PM. Violations may result in additional charges or termination of the Agreement without refund in cases of serious or repeated violations.

 

6.2. OUTDOOR EVENT SPACE:

A maximum of fifty (50) people are allowed in the RESORT. Guests who are not registered for overnight stay are not allowed on the Premises between 9:00 PM and 8:00 AM the next day. Violations may result in additional charges or termination of the Agreement without refund.

 

6.3. EXTRA GUESTS:

Extra guests require prior approval from the HOST and will be charged in accordance with Section 4.5.

 

  1. HOUSE RULES:
  • The GUEST acknowledges receipt of the attached House Rules (provided prior to or at check-in) and agrees to abide by them, and such House Rules shall form part of this Agreement.
  • The GUEST is responsible for ensuring that all Guests comply with these rules.

 

  1. 100% SMOKE-FREE INDOORS POLICY:

 

8.1. SMOKING:

  • For safety and comfort, smoking is strictly prohibited inside the VILLA (indoor areas of the Premises). This includes cigarettes, tobacco, marijuana, e-cigarettes, vaping, cigars, and incense.

 

8.2. COOKING:

  • Cooking inside the VILLA kitchen is limited to light food preparation only. Heavy cooking (e.g., grilling, frying with strong odors) must be done at the designated outdoor grilling/cooking area.

 

  1. NON-DISTURBANCE CLAUSE:

Guests must not disturb or inconvenience neighbors. Any unlawful activity or behavior in violation of applicable laws (including but not limited to drug use, violence, or illegal conduct) may result in termination of this Agreement and eviction from the Premises without refund, with or without prior notice in cases of serious or illegal violations.

 

  1. NOISE RESTRICTIONS:
  • Noise must be kept at reasonable levels at all times, especially after 10:00 PM, in accordance with local community standards. The GUEST agrees to avoid loud music, videoke, or karaoke during these hours.
  • The HOST reserves the right to reduce or cut off sound systems or require the GUEST to reduce noise levels to comply with this Agreement.

 

  1. NO PETS POLICY:

No pets of any kind are allowed on the Premises. Any violation may result in termination of the Agreement and/or additional charges, at the discretion of the HOST.

 

  1. SWIMMING POOL USE:

 

12.1. USE HOURS:

The pool and all pool areas are available for use throughout the stay, though the pool pump and jacuzzi (bubbles) will be turned off at 10:00 PM for maintenance. The GUEST will be notified if the pool is under treatment.

 

12.2. SUPERVISION:

Children must be accompanied by an adult at all times while in or near the pool.

 

12.3. SAFETY:

The GUEST agrees to follow all safety guidelines posted near the pool and avoid dangerous behavior.

 

12.4. EATING AND DRINKING:

Eating or drinking in the pool is prohibited. Food and beverages must be kept away from the pool area to maintain cleanliness and safety. Glass containers are not allowed in or near the pool area.

 

12.5. SWIMMING ATTIRE:

Appropriate swimwear must be worn at all times while using the pool.

 

12.6. POOL USE DISCLAIMER:

The GUEST acknowledges the risks associated with pool use and agrees to use the pool at their own risk. The HOST does not provide a lifeguard, and the GUEST is responsible for the safety of all users. The HOST shall not be liable for accidents or injuries, except in cases of gross negligence or willful misconduct.

 

  1. DAMAGES AND LIABILITY:

 

13.1. PROPERTY DAMAGE AND/OR THEFT:

The GUEST is responsible for any damage or theft of the Premises or its contents, whether caused by accident, negligence, or intentional acts. The GUEST agrees to cover the costs of repair or replacement.

 

13.2. DOCUMENTATION OF DAMAGES:

The HOST may document the condition of the Premises before check-in and after check-out through photos or videos. Such documentation may be used as basis for any claims for damages or deductions from the security deposit, excluding normal wear and tear.

 

13.3. LIABILITY WAIVER:

The HOST shall not be liable for any injury, loss, or damage to the GUEST or their guests, except in cases of gross negligence or willful misconduct. The GUEST agrees to be responsible for any claims, damages, or liabilities arising from their use of the Premises and agrees to indemnify and hold the HOST harmless from third-party claims arising from such use.

 

13.4. ASSUMPTION OF RISK:

The GUEST assumes all risks associated with recreational activities, including swimming.

 

13.5. PERSONAL PROPERTY:

The GUEST is advised to secure personal property insurance, as the HOST is not liable for any loss or damage to personal belongings.

 

  1. MAINTENANCE, REPAIRS, ALTERATIONS AND PROPERTY ACCESS:
  • The GUEST agrees to maintain the Premises in a clean and safe condition and to return it in the same condition, except for ordinary wear and tear.
  • The GUEST shall not make any structural changes or alterations to the Premises, including installing nails, hooks, screws, or new locks.
  • The GUEST shall promptly report any maintenance issues. The HOST will attempt to address these but cannot guarantee that all appliances or equipment will be in perfect working order. No refunds will be issued for minor or non-essential equipment or amenity malfunctions (e.g., entertainment devices, recreational equipment); however, the HOST will make reasonable efforts to repair or replace essential items.
  • The HOST or their agent may enter the Premises for inspections or maintenance with reasonable notice, and without prior notice in emergencies.

 

  1. BEDROOM POLICY:

Food and drinks are not allowed in the bedrooms to maintain cleanliness and avoid damage to furniture or bedding.

 

  1. SUB-LEASE:

The GUEST may not assign this Agreement or their right to occupy the Premises without the prior written consent of the HOST.

 

  1. PUBLIC UTILITIES:

The HOST is not responsible for any loss of use or interruption of utility services (e.g., water, electricity, internet) beyond their control but will make reasonable efforts to restore or coordinate restoration of such services when possible.

 

  1. INSURANCE:

The GUEST is encouraged to obtain personal travel insurance, including coverage for damage to the Premises and medical emergencies.

 

  1. INSPECTIONS:

The HOST reserves the right to inspect the Premises during the rental period with prior notice to ensure compliance with the Agreement.

 

  1. CCTV MONITORING:

CCTV cameras are installed in common and outdoor areas for security and monitoring purposes only. No cameras are installed in private areas such as bedrooms and restrooms.

 

  1. FORCE MAJEURE:

If the Premises become uninhabitable or substantially unusable due to force majeure events (e.g., fire, flood, storm), the HOST may cancel the Agreement and issue a full refund. Neither party shall be held liable for failure to perform due to such events.

 

  1. DATA PRIVACY:

All personal data collected shall be handled in accordance with the Data Privacy Act of 2012 and shall be used solely for booking, security, and compliance purposes, and will not be shared with third parties except as required by law.

 

  1. CANCELLATION POLICY:

Reservation deposits are non-refundable except as stated in Section 4.2. The HOST may allow rescheduling if requested at least sixty (60) days before the check-in time, subject to availability.

 

  1. JUDICIAL RELIEF:

Should the HOST need to seek legal relief against the GUEST, the GUEST agrees to pay reasonable legal costs, including attorney’s fees, to the extent permitted by applicable law.

 

  1. SEVERABILITY:

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

  1. ENTIRE AGREEMENT AND AMENDMENTS:

This Agreement supersedes any prior agreements or representations, whether written or oral. Any amendments must be in writing and signed by both parties.

 

  1. GOVERNING LAW:

This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
