Rental Agreement

TERMS AND CONDITIONS:
1. RENTAL PROPERTY:
LESSOR leases to LESSEE and LESSEE leases from LESSOR, subject to the terms and conditions of this Property Rental Agreement, the following property:
1.1. PROPERTY ADDRESS: 6502 Michael Street, Remedios Ville Subdivision, Capaya 1, Angeles City
1.2. DESCRIPTION OF PROPERTY: A private villa and all its fixtures, furniture, appliances, and amenities that are being rented under this Agreement (hereinafter, “the Premises”).
1.3. AREAS OF THE PREMISES: The Premises is separated into two areas:
1.3.1. LODGING AREA: The indoor area (hereinafter, “VILLA”) is the 2-storey 3-bedroom house and all its fixtures, furniture, appliances, and amenities inside the house, including the living room, kitchen, dining area, bedrooms, and bathrooms.
1.3.2. OUTDOOR EVENT SPACE: The outdoor area (hereinafter, “RESORT”) consists of the pool, pavilion, outdoor garden area, outdoor showers, outdoor bathrooms, outdoor event space and all fixtures, furniture, appliances, and amenities located outside the VILLA.
1.4. PROPERTY USE: The Premises is to be used only for short-term residential stay and private events.
1.5. OTHER AMENITIES: LESSOR provides the following items and appliances for LESSEE’s use during their stay:
1.5.1. BEDROOMS: Air conditioner, bedding, pillows, and flat sheets;
1.5.2.KITCHEN: Refrigerator, water dispenser, electric kettle, rice cooker, 15 sets of plates, glasses, spoons, forks, teaspoons, and coffee mugs;
1.5.3. RESORT: Billiard table with 16 balls & billiard sticks, Pinoy pool table, badminton set, 3 calesa tables with big umbrellas, 5 folding tables, 2 long tables, 50 plastic chairs, grilling station;
1.5.4. FREE ITEMS: four bottles of 5-gallon filtered water, three rolls of toilet paper.2.
2. TERM OF LEASE:
This Agreement shall commence on Check-In Date and Time and shall terminate on Check-Out Date and Time. LESSEE agrees that the Premises will be ready for occupancy no earlier than check-in time and must be vacated no later than check-out time. Thirty minutes (30 minutes) before Check-Out Time, the LESSOR or their agent will evaluate and inspect for any damage, violations or loss in the Premises.
3. RENTING PARTY:
The Renting Party (hereinafter, “Guests”) shall consist of the LESSEE and the LESSEE’s guests and visitors, and anyone else permitted by LESSEE on the Property. LESSEE agrees to be 100% responsible for the conduct of all Guests.
4. RENTAL FEES, DEPOSITS AND OTHER CHARGES:
4.1. RENT. The Rent for the use of the Premises is Rent Amount (Php Rent in Figures), payable on or before [insert date ten days before Check-In Date]:
4.2. RESERVATION DEPOSIT: A non-refundable reservation deposit of Five Thousand Pesos (Php5,000.00) is required at the time of reservation in order to secure the booking. This deposit will be applied as a credit towards rent. This amount will be forfeited in favor of the LESSOR if the LESSEE cancels a confirmed reservation.
4.3. SECURITY DEPOSIT: A refundable security deposit of Five Thousand Pesos (Php5,000.00), payable on or before [insert date ten days before Check-In Date], is required to cover any damages, missing items, fees, or excessive cleaning costs. This is to be refunded within 1 day after check-out, less any deductions for damages, missing items or additional charges. If the cost of missing items, unsettled charges, and damages caused by Renting Party exceeds the Security Deposit, such cost will be billed to the LESSEE.
4.4. OVERSTAY/LATE CHECKOUT FEE: An overstay/late checkout fee of One Thousand Pesos (Php1,000.00) per hour will be charged for stay beyond Check-out Time.
4.5. EXTRA GUEST FEE: An Extra Guest Fee of Three Hundred Pesos (Php300.00) per person will be charged for each additional guest beyond the agreed number.
4.6. CLEANING FEE: A Cleaning Fee of Five Hundred Pesos (Php500.00) will be charged for cleaning excessive dirt.
4.7. SMOKING FEE: A Smoking Fee of One Thousand Pesos (Php1,000.00) will be charged if a Guest violates the no-smoking policy in the Premises.
5. PAYMENTS:
5.1. MODE OF PAYMENT: All payments due herein shall be made via cash, GCash, PayMaya or bank transfer. LESSOR will provide LESSEE the payment instructions upon confirmation of the booking.
5.2. LATE PAYMENTS: If full payment is not made on or before the due date, the reservation will be deemed cancelled and any amount paid as Reservation Deposit is forfeited, as stated in Section 4.2, without further notice.
6. MAXIMUM OCCUPANCY AND HOURS OF USE:
6.1. LODGING AREA: The maximum number people allowed for overnight stay in the VILLA is fifteen (15). The names of Guests staying overnight must be provided during Check-in for registration. Only registered guests will be allowed inside the VILLA after 9:00 P.M.
6.2. OUTDOOR EVENT SPACE: A maximum of fifty (50) people are allowed in the RESORT. Guests who are not registered for overnight stay are not allowed to stay on the premises between 9:00P.M. until 8:00A.M. the next day.
6.3. EXTRA GUESTS: Additional guests beyond the agreed number must receive prior approval from the LESSOR and may incur an additional Extra Guest Fee of three hundred pesos (Php300.00) per person.
7. HOUSE RULES:
LESSEE agrees to abide by the HOUSE RULES at all times while at the property and shall cause all members of the rental party and anyone else Renter permits on the property to abide by the said rules at all times while on the Premises.
8. 100% SMOKE FREE POLICY:
8.1. SMOKING: For safety and to assure that the Premises is not exposed to items or actions that create an odor that is unhealthy and objectionable to our guests and staff, and that is difficult to remove from the air, carpet, walls, and furniture, LESSOR does not permit smoking cigarettes, tobacco, marijuana, illegal drugs, e-cigarettes, vape pens, vaping, cartridges containing the liquid of nicotine, hookahs, incense, and cigars in the Premises. This policy is not intended to stop people from smoking, but to regulate where they smoke and how it affects others. A designated Smoking Area is provided at the parking area behind the Resort.
8.2. COOKING: Cooking is not allowed indoors as the odor is difficult to remove.
9. NON-DISTURBANCE CLAUSE:
Guests shall not create a nuisance by disturbing, annoying, endangering or inconveniencing neighbors, nor use the Premises for any unlawful purposes. Illegal activities such as, but not limited to, illicit drug use, verbal or physical abuse of any person, and illegal sexual behavior shall cause immediate termination of this Agreement without refund.
10. NOISE RESTRICTIONS:
Events that generate excessive noise are not allowed. LESSEE agrees to adhere to the community noise guidelines and to ensure all guests respect noise levels, particularly during nighttime hours. Videoke/karaoke and playing of loud music is up to 10:00PM only.
11. NO PETS POLICY:
LESSOR has a strict No Pets Policy. No pets of any kind are allowed within the Premises at any time. If any member of the Renting Party brings a pet despite the “no pets” policy, LESSOR may immediately terminate this Agreement ask the Renting Party to leave without refund.
12. LIGHTS:
Electric powered lights in the RESORT will be turned off at 10:00P.M. Solar lights come with an inbuilt light sensor that automatically turns the light on at dusk and off at dawn
13. SWIMMING POOL USE:
13.1. USE HOURS: The swimming pool is available for use between 6:00AM and 10:00PM.
13.2. SUPERVISION: Children must be accompanied by an adult at all times while in or around the pool.
13.3. SAFETY: LESSEE agrees to follow all safety guidelines posted near the pool area and to not engage in dangerous or reckless behavior.
13.4. EATING AND DRINKING. Eating any kind of food and drinking any kind of drinks especially alcoholic beverages beside or inside the swimming pool is strictly prohibited.
13.5. SWIMMING ATTIRE: Appropriate swimwear must be worn at all times while using the pool.
13.5. POOL USE DISCLAIMER: The Premises includes a swimming pool for the use of LESSEE and his guests. By using the pool and event space, LESSEE acknowledges the inherent risks and agrees to hold LESSOR harmless for any injury or damage that may occur during the stay. LESSOR does not provide a lifeguard on duty, and the LESSEE agrees to take full responsibility for the safety of all persons using the pool, including children. LESSOR is not responsible for any accidents, injuries, or damages related to the use of the pool.
14. DAMAGES AND LIABILITY:
14.1. PROPERTY DAMAGE AND/OR THEFT OF PROPERTY: LESSEE is liable for any damage to the Premises, including furniture, fixtures, and equipment, howsoever caused (whether by the deliberate, negligent, or reckless act) by any person in the Renting Party during their stay and shall reimburse LESSOR for the cost of repair or replacement.
14.2. LIABILITY WAIVER: The LESSOR is not responsible for any injury, loss, or damage to the LESSEE or their guests during the rental period, whether inside or outside the Premises. The LESSEE agrees to indemnify, hold free and harmless, and defend at its own expense the LESSOR, its agent, employees, or workers, from and against any and all suits, claims, demands, and liabilities of any nature or kind, including those of third parties, arising out of, or in any way related to, LESSEE’s use of Premises or the items of personal property provided therein.
14.3. ASSUMPTION OF RISK: LESSEE assumes all risk of injury or other losses relating to any recreational activities including use of the swimming pool on the Premises and will hold LESSOR harmless with respect thereto.
14.4. PERSONAL PROPERTY: The LESSEE is advised to secure personal property insurance, as the LESSOR is not liable for any loss or damage to the LESSEE’s personal belongings.
15. REPAIRS AND MAINTENANCE:
15.1. MAINTENANCE: LESSEE shall keep the premises in a clean, sanitary, and safe condition; use and maintain any furniture and/or appliances found in the premises with the due diligence of a good father of a family; and return the premises and any furniture and/or appliances to LESSOR in a condition identical to that which existed when LESSEE took occupancy, except for ordinary wear and tear. Failure to comply may result in a cleaning fee set out in Section 4.6 above.
15.2. ALTERATIONS: LESSEE shall not make any structural alteration, addition, or improvement on the Premises; drive nails, hooks, screws, etc. on the walls, ceiling, or floors of the Premises; alter, add, or replace any locks on the Premises.
15.3. REPAIRS: LESSEE shall report immediately to LESSOR any items requiring repair, defects, or dangerous conditions in and about the Premises. LESSOR will make every effort to repair and/or replace any equipment that is not working properly, but cannot guarantee that all equipment is in good operating order at all times and no rate adjustments or refund will be made for equipment or appliance failures.
15.4. ACCESS TO PROPERTY: LESSOR or their agent may enter the Property upon reasonable notice to inspect for maintenance needs or emergency situations. In case of an emergency, the LESSOR has the right to enter the Property without notice.
16. EATING AND DRINKING IN THE BEDROOMS: Food and drinks are not allowed inside the bedrooms.
17. SUB-LEASE: LESSEE shall not sublet or assign this lease for all or any part of the premises without prior written consent of the LESSOR.
18. PUBLIC UTILITIES: LESSOR shall not be responsible and/or held liable for any loss of use, discontinuation or interruption of any utility services beyond LESSOR’s control. This includes electricity provided by Angeles Electric Corporation, water provided by Prime Water, and internet services provided by Globe Telecom.
19. INSURANCE AND INSPECTIONS
19.1. INSURANCE: LESSEE is encouraged to obtain personal travel insurance that includes coverage for damage to the Premises and any medical emergencies that may occur during the stay.
19.2. INSPECTION OF PROPERTY: The LESSOR reserves the right to inspect the Premises at any time during the rental period, with prior notice, to ensure compliance with the terms of this Agreement.
20. CANCELLATION POLICY:
20.1. CANCELLATION BY LESSEE: LESSEE may cancel the booking 60 days before Check-in Date for a full refund of any payments made minus any bank or online payment processing fees, if applicable.
20.2. CANCELLATION BY LESSOR: If the LESSOR cancels the booking for any reason, the LESSEE will be refunded the full amount paid, including the reservation deposit, within one day.
21. CCTV MONITORING: CCTV cameras are installed at the premises for monitoring/security purposes, except bedrooms, restrooms and other private areas.
22. FORCE MAJEURE: If whole or any part of the Premises shall be destroyed or damaged by fire, flood, lightning, typhoon, earthquake, storm, riot, or any other unforeseen disabling cause of acts of God, or if there is facility failure, as to render the Premises substantially unfit for use and occupation of LESSEE during the Term, then this Agreement may be cancelled by LESSOR and any money paid by LESSEE will be refunded in full.
23. JUDICIAL RELIEF: Should LESSOR be compelled to seek judicial relief against LESSEE, LESSEE shall pay all reasonable costs, LESSOR’s attorney’s fees, and expenses that shall be made or incurred by the LESSOR in addition to other claims, costs and damages which the said party may be entitled to under the law.
24. VALIDITY OF EACH PART: If any portion of this Agreement is held to be invalid, its invalidity will not affect the validity or enforceability of any other provisions of this Agreement
25. MISCELLANEOUS
24.1. ENTIRE AGREEMENT: This Agreement represents the entire contract between the parties and supersedes any prior agreements or understandings, whether written or oral.
24.2. AMENDMENTS: Any amendments or modifications to this Agreement must be made in writing and signed by both parties.
